| English abstract | The present work has as scope the investigation of the anticipatory measures as a way to achieve the due processo f law garantie and the demonstration that the art. 273 of the brasilian Civil Procedure Code means the preponderance of the fundamental right of effectiveness over the fundamental right to security. In a second moment comes the examination of the question concerning the constitucionality of the procedure rules that establish limitations to the concession antecipatory measures and the conclusion that such limitations are authorized by the Constituition |
| Portuguese abstract | O presente trabalho tem como escopo investigar a tutela antecipada como forma de realização da garantia do devido processo legal e demonstrar que o art. 273 do CPC significa a preponderância do direito fundamental à efetividade sobre o direito fundamental à segurança. Num segundo momento examinase a questão da constitucionalidade das regras que limitam a concessão de liminares para concluir pela legitimidade constitucional de tais limitações |
