| Resumen en portugués | O presente trabalho tem como escopo investigar a tutela antecipada como forma de realização da garantia do devido processo legal e demonstrar que o art. 273 do CPC significa a preponderância do direito fundamental à efetividade sobre o direito fundamental à segurança. Num segundo momento examinase a questão da constitucionalidade das regras que limitam a concessão de liminares para concluir pela legitimidade constitucional de tais limitações |
