| English abstract | Through the historical and bibliographical method, this article aims to present a critical appraisal of the logic and rhetoric evolution, specifically how the enthymemes are currently used to support judicial decisions. The paper intends to prove that the decision-making precedes the writing process and it is not necessarily guided by a formal logic reasoning but, especially, through an ideological motivation, and also that the wording can be done based on enthymemes |
| Portuguese abstract | Através do método histórico e bibliográfico este artigo objetiva construir um diagnóstico crítico sobre a evolução da lógica e da retórica, e, em especial, como os entimemas são utilizados, atualmente, para fundamentar decisões judiciais. Pretende-se comprovar que a decisão judicial precede sua respectiva escritura e que não é, necessariamente, orientada por um raciocínio lógico-formal, mas, sobretudo, através de uma motivação ideológica, bem como que a construção gramatical da decisão pode efetivar-se com base em entimemas |
