| English abstract | The present study addresses arguments about the legal treatment of the modern familiar plurality. To do so, briefly approaches the roots of family as institution and the contemporary elements that have altered its features. After this, aims the families new models and their essential characteristics, and the possible legal effects derived from modern conjugalities not yet specified in the legal system. Therefore, because such a legislative omission, is necessary to propose as remedy for that matter the use of analogical interpretation under the constitutional bias (via art. 226 of CF/88), since the new forms of family can’t remain invisible to the legal system, that would be responsible for the degradation of human dignity of all the individuals evolved on these situations and also the increasing of legal disputes |
| Portuguese abstract | O objetivo com este estudo foi apresentar argumentos sobre o tratamento legal da moderna pluralidade familiar. Para tanto, fez-se breve digressão sobre a família secular como instituição e os elementos contemporâneos que lhe alteraram a feição. Em seguida, foram focalizados os principais novos modelos de famílias, bem como suas características essenciais e os possíveis efeitos jurídicos oriundos das conjugalidades modernas e que ainda não possuem albergue legal específico. Portanto, diante de tal omissão legislativa é que se propôs o uso da interpretação analógica, sob o viés constitucional (via art. 226, da CF/88), como remédio jurídico para tal questão, uma vez que os novos arranjos familiares não podem permanecer invisíveis legalmente, sob pena do desprestígio da dignidade humana de seus partícipes e agigantamento da litigiosidade |
