| Resumen en inglés | This article aims to analyze the right to leave of the refugees throught the sight of cosmopolitan law in the perceptions of Immanuel Kant and Jacques Derrida, due to the current situation of the world scenario in which the world number of refugees grows annually. To do so, the areas of philosophy of law and international law were covered using the dialectic-deductive method, through the reading and analysis of books, scientific articles and international conventions. Thus, the legal institute of the refuge was analyzed as a means of protecting human rights and the right to leave of the refugees from the perspective of cosmopolitan law. It was concluded by the need of the unification of the States around the rights that were consecrated in the Universal Declaration of Human Rights and the Convention Relating to the Status of Refugees of 1951, as well as the concept of cosmopolitan law, in order to protect refugees from various rights violations, which they suffer constantly |
| Resumen en portugués | O presente artigo tem como escopo a análise do direito de partir dos refugiados a partir do direito cosmopolita nas percepções de Immanuel Kant e Jacques Derrida, em razão da atual conjuntura do cenário mundial em que cresce o número mundial de refugiados anualmente. Para tanto, foram abrangidas as áreas da filosofia do direito e do direito internacional, utilizando-se do método dialético-dedutivo, através da leitura e análise de livros, artigos científicos e convenções internacionais. Assim, analisou-se o instituto jurídico do refúgio como meio de proteção aos direitos humanos e o direito de partir dos refugiados sob a ótica do direito cosmopolita. Concluiu-se pela necessidade da unificação dos Estados em torno dos direitos consagrados pela Declaração Universal de Direitos Humanos e pela Convenção Relativa ao Estatuto dos Refugiados de 1951, assim como pelo conceito de direito cosmopolita, a fim de proteger os refugiados das diversas violações de direitos que sofrem constantemente |
