| Spanish abstract | El proceso civil predominante en Iberoamérica, dominado por la escritura, ha sido criticado por ser el causante de la lentitud de los trámites legales y la demora en resolver los pleitos como por desmejorar la calidad de la justicia, ya que las decisiones las toma un juez que, a menudo, no ha tenido el suficiente conocimiento de la causa y que forma su convicción basándose solamente en el escrito. Este artículo señala las ventajas de implementar el proceso civil por audiencias en nuestras legislaciones, así como la necesidad de incorporar diversas figuras jurídicas que servirían a los fines de obtener una sentencia de fondo justa en un tiempo razonable |
| English abstract | The predominant civil procedure in Latin America, dominated by the writing, has been criticized for being the responsible of the slowness of legal stages and the delay in solving the lawsuits as for deteriorating the quality of justice, because the decisions are taken by a judge that, usually, has not enough knowledge of the case and that forms its conviction based only in the writings. This article shows the advantages of implementing a civil procedure through hearings, as well as the need of incorporating some legal figures that could serve to the goals of obtaining a just sentence in a reasonable time |
