| Spanish abstract | La presente investigación jurídica tiene como objetivo analizar desde una perspectiva panorámica el presente de la familia en el derecho occidental del siglo XXI, con particular énfasis en el derecho chileno y latinoamericano. Para este fin, se propone analizar los principales factores que dan cuenta de la transición de un modelo centrado en la familia, a un sistema de carácter individualista donde la familia se conforma como una herramienta para el desarrollo de la personalidad. Desde esta mirada, se presenta la idea de un pluralismo jurídico familiar, cuyo paradigma acoge la noción de un derecho de familia amplio, sustentado en la existencia y reconocimiento de diversos fenómenos jurídicos. Esto permitirá armonizar situaciones de conflicto normativo, y facilitará la tarea encomendada al Estado de garantizar el bien común |
| English abstract | This legal research aims to analyze from a panoramic perspective where does the concept of family rest under western law in the XXI century, with particular emphasis on Chilean and Latin American law. That is why it is necessary to analyze the main factors that account for the transition from a family-centered model to an individualistic system where the family is seen as an instrument for the development of personality. From this perspective, the idea of a family legal pluralism is presented, whose paradigm welcomes the notion of a broad family law, based on the existence and recognition of various legal phenomena. This will allow to harmonize the different situations of normative conflict, and will facilitate the task entrusted to the State to guarantee the common good |
