| English abstract | The present work aims to verify the phenomenon of banalization of the argument jusfundamental especially by unjustified and excessive reasons of constitutionalization of Brazilian constitution. From this, want to demonstrate the origim "insatiable rights" and, consequently, the unjustified solipism juridic, which ends up interfering in the effectiveness and the realization of fundamental rights. In this way, the text concluded that the law ativism, as it is practiced in the country, ends up being hypertrophied the fundamental rights, especially to consider an anti-democratic way that are applied by the judges. Thus, it was verified the importance of considering as fundamental obrigations notions, as a tool to avoid the misuse of arguments based on fundamental rights. | Portuguese abstract | O presente trabalho visa verificar o fenômeno da banalização do argumento jusfundamental especialmente em razão da injustificada e excessiva constitucionalização do Direito brasileiro. A partir disso, almeja-se demonstrar o surgimento dos intitulados “direitos insaciáveis” e, consequentemente, o indevido solipsismo jurídico, que acaba por interferir na efetividade e na concretização dos direitos fundamentais. Desse modo, o texto concluiu que o ativismo judicial, na medida em que é praticado no país, acaba hipertrofiando a concepção de direitos fundamentais, ainda mais ao considerar a maneira antidemocrática como são aplicados pelos juízes. Assim, verificou-se a importância de se considerar as noções dos deveres fundamentais, como ferramenta para evitar a utilização indevida do argumento pautado nos direitos fundamentais. O trabalho foi realizado por meio de pesquisa bibliográfica qualitativa e, na escrita, utilizou-se o procedimento dedutivo |
