| English abstract | The administrative process is under the guarantee of the due process of law, having necessarily to observe the contradictor y and the ample defense, comprehending in the first one, the right to evidence. The administrative preclusion, which corresponds to the “res judicata” of the judicial process, render the administrated person safe and sound from new investigations in relation to the same fact, but not in relation to new facts, posterior to the preclusion. The Administration has to follow the principles of impartiality and impersonality, as well as the principle of the legitimate confidence, in which the principles of juridical security and of good faith are anchored. Therefore it should be concluded that there is a connection between the principles of the judicial process and the principles of the Administrative Law |
| Portuguese abstract | O processo administrativo submete-se às garantias do devido processo legal, devendo necessariamente observar o contraditório e a ampla defesa, compreendido, no primeiro, o direito à prova. A preclusão administrativa, correspondendo à coisa julgada do processo judicial, põe o administrado a salvo de novas investigações pelo mesmo fato, a não ser em relação a fatos novos, supervenientes à preclusão. Aplicam-se à Administração os princípios da imparcialidade e da impessoalidade, bem como o princípio da confiança legítima, no qual se ancoram a segurança jurídica e a boa-fé. Conclui-se, portanto, existir um entrelaçamento entre os princípios do processo judicial e os princípios do direito administrativo |
