| English abstract | The present article intend to verify if the technical discretionary as a means of performance in the regulation of the market, on the part of the Regulatory Agencies, can strengthen - when guaranteeing aspects technician in the regulation - the legal security relatively to the regulated sector and search greater protection to the users of the public services. | Portuguese abstract | O presente artigo pretende verificar se a discricionariedade técnica como meio de atuar na regulação do mercado, por parte das Agências Reguladoras, pode reforçar – ao garantir aspectos técnicos na regulação – a segurança jurídica relativamente ao setor regulado e buscar maior proteção aos usuários dos serviços públicos. Para tanto, partirá da análise da Consulta Pública nº 847/2007 da Agência Nacional de Telecomunicações – Anatel, levando em consideração alguns parâmetros e critérios utilizados na aplicação das sanções administrativas |
