| English abstract | The main aspect of this article is the investigation of a kind of adoption in Brazil, which is not carried out according to the rules. On the contrary in this case a person (or a couple) registers a child under her, his (or their) name, so that the child is considered to be the proper (i.e.: biologically related) offspring. Even though such a misleading registration is a crime under the Brazilian Penal Code this kind of “adoption” is nevertheless widespread in the country. This procedure raises two questions: as to whether the person who registered the child has the right to appeal against this registration, by providing evidence that there is no biological relation to the child, and as to whether this attitude goes against the human dignity of the child. | Portuguese abstract | Neste artigo tratar-se-á da chamada “adoção à brasileira”. O fulcro da investigação está centrado na possibilidade de uma pessoa, que registrou como seu, filho que não era, anular o registro de nascimento. O motivo para isso seria o de não ser o genitor biológico da criança. Como não se cuida aqui de reconhecimento de paternidade ou de maternidade, porquanto a pessoa de livre e espontânea vontade registrou a criança como sua filha, não se poderia alegar erro no registro, o que impossibilitaria sua anulação.
