| Spanish abstract | Este artículo argumenta que el concepto de derechos humanos resulta problemático para la teoría de sistemas,dado que esta teoría se enfoca en la diferenciación funcional de estructuras, mientras que los derechos humanos no pueden ser concebidos únicamente como elementos jurídicos, políticos o morales. Argumento que los derechos humanos son estructuras multifuncionales. Este argumento se desarrolla reconstruyendo las reflexiones teóricas en torno a los derechos humanos en la teoría de sistemas. Finalmente, argumentaré que los derechos humanos operan no sólo como expectativas normativas que restringen la acción estatal por medio de libertades individuales, sino que también legitiman su intervención en áreas no-políticas a fin de garantizar derechos sociales |
| English abstract | The article argues that human rights concept is problematic for systems theory since it focuses on functional differentiation of structures, while human rights cannot be conceived exclusively either as juridical, political or moral elements. I argue that human rights are multifunctional structures. This argument is developed by reconstructingthe theorical reflections about human rights on systems theory. Finally, I’ll argue that human rights work not only as normative expectations that restrain State action by means of individual liberties, but they also legitimate political intervention in non-political areas to guarantee social rights |
