| Spanish abstract | En esta investigación se realiza un estudio al papel que desempeña la mujer que participa como gestante sustituta dentro de la práctica reproductiva conocida como vientre de alquiler, a fin de conocer en qué consiste su participación, cómo se lleva a cabo, riesgos y consecuencias a las que queda expuesta su salud ante el uso de hormonas y tratamientos diversos para lograr el embarazo o gestación por contrato; de igual forma se estudian situaciones legales que pueden tener lugar a partir de una inacabada regulación jurídica respecto de la denominada maternidad subrogada, así como al uso de las técnicas de reproducción asistida humana. Se retoma el efecto de la globalización e impulso capitalista al desarrollo y proliferación de esta modalidad reproductiva, que da lugar al libre juego de oferta y demanda, que hace campo propicio para celebrar acuerdos de gestación subrogada con o sin regulación jurídica de por medio, donde ante cualquier eventualidad no prevista en el contrato, norma jurídica, o bien ante la inexistencia de ésta, se den consecuencias irreversibles para todos los involucrados, en particular para los más vulnerables, como lo son la gestante sustituta y el neonato, por ello la importancia de atender y profundizar en este tema |
| English abstract | In this research, a study is carried out on the role played by the woman who participates as a surrogate mother within the reproductive practice known as surrogacy, in order to know what her participation consists of, how it is carried out, risks and consequences that their health is exposed to the use of hormones and various treatments, to achieve pregnancy or gestation by contract; Similarly, legal situations that may take place from an unfinished legal regulation regarding the so-called surrogacy are studied, as well as the use of human assisted reproduction techniques. The effect of globalization and capitalism impulse to the development and proliferation of this reproductive modality is retaken, which gives rise to the free interplay of supply and demand; that makes a suitable field to celebrate surrogacy agreements with or without legal regulation in between, where in the event of any eventuality not foreseen in the contract, legal norm, or in the absence of this, irreversible consequences are given for all those involved, in particularly for the most vulnerable such as the surrogate mother and the newborn, therefore the importance of attending and going deep into this issue |
