| Spanish abstract | El artículo analiza diversos criterios emitidos por la Corte Interamericana de Derechos Humanos sobre migración. Se enfoca en aquellos que se refieren al uso de la fuerza de los encargados de la seguridad pública, y al derecho de acceso a la justicia de la población migrante. Todo ello, considerando el incremento de la movilidad humana externa en América Latina, a consecuencia de la pobreza, la violencia, la falta de oportunidades de desarrollo, los abusos de quienes ejercen el poder público y el crimen organizado. Esto es relevante debido a que son las personas que detentan poder quienes, de manera generalizada, actúan con discriminación y racismo, ocasionando segregación, explotación, trata de personas, homicidios. Todas estas situaciones deben abordarse desde la perspectiva de los derechos humanos, para proteger a toda persona, sin distinción de nacionalidad. Metodológicamente, se utilizaron fuentes documentales, aplicando los métodos analítico-deductivo, inductivo y comparativo, que sintetizaron las discusiones planteadas en torno al reconocimiento de los derechos de los migrantes en condición de irregularidad |
| English abstract | The present article analyzes various criteria emitted by the Inter-American Court of Human Rights in the area of migration, focusing both on those referring to the use of force by the individuals entrusted with pubic security and on the migrant population’s right to access to justice. It will consider the increase in external human mobility in Latin America that has resulted from poverty, violence, lack of development opportunities, abuses by those exercising public power, and organized crime. This is of interest due to the fact that those wielding power, in a generalized sense, display discrimination and racism, leading to segregation, exploitation, people trafficking, and homicide. The above-described situations must be approached from a human rights perspective, in order to protect all people, regardless of nationality. The methodology applied involved the use of documental sources, on which analytic-deductive, inductive, and comparative methods were applied to summarize/synthesize the discussions established around the recognition of the rights of unregularized migrants |
