| Spanish abstract | El presente artículo tiene como objetivo analizar las posibilidades de uso de sistemas de inteligencia artificial en el procedimiento de mediación. Para su realización se parte de la distinción entre mediación y mediación electrónica, y entre esta y la que utiliza inteligencia artificial. El análisis se realiza desde dos perspectivas, a) la sustitución de la figura del mediador por el sistema y b) la utilización de este último como auxilio en el proceso de mediación. Se concluye que estos sistemas presentan limitaciones tecnológicas que inciden en la naturaleza del procedimiento por lo cual la existencia de procedimientos totalmente automatizados significaría su desnaturalización como mecanismo alternativo de resolución de controversias, al menos desde el actual desarrollo de la tecnología |
| English abstract | This article aims to analyze the possibilities of using systems of artificial intelligence systems in the mediation procedure. For its realization it is based on the distinction between mediation and electronic mediation, and between it and the one that uses artificial intelligence. The analysis is carried out from two perspectives, a) the replacement of the mediator’s figure by the system and b) the use of this system as an aid in the mediation process. It is concluded that these systems have technological limitations that affect the nature of the procedure and the main characteristics of this, so that the existence of fully automated procedures means a denaturation of this alternative dispute resolution mechanism, at least since the current development of the technology |
