| Spanish abstract | La Constitución del Ecuador de 2008 reconoce varios mecanismos para la garantía jurisdiccional de los derechos. Las garantías pretenden prevenir potenciales violaciones a los derechos y reparar aquellas que ya han ocurrido. Entre las garantías preventivas encontramos las normativas, las políticas públicas y las medidas cautelares. Entre las garantías reparadoras encontramos a la acción de protección de derechos. Este panorama “garantista” es completamente nuevo en el sistema jurídico ecuatoriano y, me atrevería a afi rmar, al menos en términos constitucionales, en el derecho comparado. | English abstract | The 2008 Constitution of Ecuador recognizes various mechanisms in order to guarantee the jurisdictional protection of the law. These guarantees attempt to prevent potential infringement of people’s rights and restore those that have already occurred. Within preventive measures we fi nd regulative norms, public policies and precautionary measures. Among the remedial actions of the law we also fi nd the protective action of their rights. This view as a “guarantor” is new to the Ecuadorian legal system, I would dare say at least in constitutional terms, and in comparative law. This article is a study of these institutions |
