| Spanish abstract | Este ensayo enfrenta los temas conceptuales que permiten aquilatar la magnitud de la irrupción de la IA, la robótica y el Big Data al concluir la segunda década del siglo XXI. Hace un repaso por las sorprendentes bondades que ofrece al hombre la tecnología inteligente que pretende ser autónoma y que, por esa misma razón, plantea desafíos éticos no fáciles de abordar y menos de resolver. La Era Digital está removiendo, desde sus raíces, la forma que tenemos de entender el Derecho positivo, como una potestad de imperium del Estado, pues la regulación normativa de la actividad humana, con inusitada rapidez, está pasando a la iniciativa privada. La UE ha generado importante normativa regional que bien podría servir de guía para el resto de Estados en el mundo. La robótica, en particular, genera honda preocupación en el ámbito de la responsabilidad civil y en el mundo laboral por la potencial eliminación de fuentes de empleo para los seres humanos |
| English abstract | This essay addresses the conceptual themes that allow the magnitude of the emergence of AI, robotics and Big Data at the end of the second decade of the 21st century. It reviews the surprising goodness offered to man by intelligent technology that is intended to be autonomous and, for the same reason, poses ethical challenges that are not easy to address and less to solve. The Digital Age is removing, from its roots, the way we understand positive Law, as a power of imperium of the State, because the regulation of human activity, with unusual speed, is moving to private initiative. The UE has generated important regional regulations that could well serve as a guide for the rest of the world. Robotics, in particular, raises serious concern in the field of civil liability and in the world of work due to the potential elimination of sources of employment for human beings |
