| English abstract | This article analyses the historical precedents of two actiones in factum created by the praetor -actio de effusis vel deiectis and actio de positis vel suspensis-, specifies their contents, systematizes their main characteristics, follows their historical course from Rome to the contemporary legal systems and, lastly, demonstrates the way in which those actions have had a continuation through the years in institutions of modern tort law |
