| Spanish abstract | El presente artículo pretende sustentar cómo la falta de continuidad en las políticas públicas ha afectado la aplicación del principio de confianza legítima, el cual suele considerarse suficiente para resolver, mediante la reubicación, la tensión entre la protección del espacio público y el derecho al trabajo de los vendedores estacionarios informales. En este sentido, se hace un llamado de atención tanto al Estado (legisladores, gobiernos locales y jueces) como a los ciudadanos en general para que se dé un esfuerzo conjunto en la comprensión del principio (y de su alcance), y en darle un uso que realmente solucione el conflicto entre derechos, en vez de buscar beneficios particulares (en ocasiones de mala fe) a partir de la incertidumbre que genera la disparidad en las medidas |
| English abstract | The thesis of the present paper is to support that the lack of continuity on public policies has affected the legal application of the legitimate expecta tions principle, which often is considered such as the best tool in order to solve, through relocation, the tension between public space protection and the right to work entitled to the peddlers and itinerant vendors. Because of that, on the following text there is a call for reflection directed to the state (legislators, local governors and judges) and to the citizens, in order to rethink the meaning of the above mentioned principle and its scope as well as in establishing the right way of applying it; a right way to the tension among rights, instead of looking forward particular benefits (even abusing of the good faith principle), from the uncertainty that generates disparity of public policies |
