| Spanish abstract | En el presente artículo se desarrolla la tesis que establece que la soberanía popu-lar es un valor porque es expresión de la necesidad histórica y del progreso de la humanidad en la búsqueda de elementos para solventar el conflicto democráti-co. Dicho en otras palabras, la democracia descansa en la significación social posi-tiva que los individuos atribuyen al principio de soberanía popular y la legitimidad que implica su realización. En igual sentido, se fundamenta que la titularidad como faceta conceptual de la soberanía popular está en crisis y que la única manera de solventarla es acudir a la emancipación del soberano. De lo anterior se concluye, entre otras cuestiones, que la búsqueda de la justicia social y la dignidad plena del ser humano fundamentan la necesidad de una ordenación jurídica diferente de la sociedad, a partir de repensar su fuente de legitimidad |
| English abstract | This article develops the thesis that establishes that popular sovereignty is a value because it is an expression of the historical need and the progress of humanity in the search for elements to solve the democratic conflict. In other words, democracy rests on the positive social significance that individuals attribute to the principle of popular sovereignty and the legitimacy that its realization implies. In the same sense, it is based that ownership as a conceptual facet of popular sovereignty is in crisis and that the only way to solve it is to go to the emancipation of the sovereign. From the foregoing it is concluded, among other issues, that the search for social justice and the full dignity of the human being base the need for a different legal order of society, based on rethinking its source of legitimacy |
