| Spanish abstract | Este artículo analiza la reciente reforma del derecho chileno que, conforme con el principio de igualdad constitucional, permitirá que los padres puedan deter-minar un orden de los apellidos diverso al tradicional para sus hijos comunes, pudiendo desde ahora anteponer el apellido materno al paterno. Al mismo tiempo, esta legislación establece la posibilidad de que en la adultez se pueda invertir el orden de los apellidos atribuido en la partida de nacimiento. Para este fin se examinan las principales reglas aplicables a la determinación y cambio del orden de los apellidos, sus efectos en las familias y respecto de terceros, los resguardos incorporados para evitar su mal utilización y, finalmente, algunos as-pectos regulados insuficientemente |
| English abstract | This article analyzes the recent reform of Chilean law that, in accordance with the principle of constitutional equality, will allow parents to determine a different order of surnames from the traditional one for their common children, being able from now on to put the maternal surname before the paternal. At the same time, this legislation establishes the possibility that in adulthood the order of surnames attributed in the birth certificate can be reversed. To this end, are examined the main rules applicable to the determination and change of the order of surnames, their effects on families and with respect to third parties, the safeguards incorporated to prevent their misuse and, finally, some insufficiently regulated aspects |
