| Spanish abstract | El aumento de la movilidad internacional de los cubanos, el desarrollo de las relaciones de comercio y del turismo internacional, así como la existencia de nuevas formas de propiedad reconocidas en la actual Constitución cubana, con-llevan a que también sean más las relaciones jurídicas con elementos extranje-ros. Lo anterior confirma la necesidad de que se instrumente un nuevo sistema de normas de Derecho internacional privado en Cuba. En materia de sucesio-nes internacionales, el sistema conflictual cubano presenta métodos y técnicas de reglamentación que hoy resultan insuficientes; a su vez, exige actualizarse y debe atender a la necesidad que existe de dar respuestas a la diversidad de situaciones que se manifiestan en este tipo de relaciones privadas internaciona-les. En tal sentido, en este artículo, las autoras realizan una propuesta de bases teóricas que podrán servir de sustento para una adecuada concepción del sis-tema conflictual cubano en materia de sucesiones internacionales, en aras de favorecer el respeto a la autonomía de la voluntad del testador y el derecho a la sucesión por causa de muerte de sus herederos |
| English abstract | The increase in the international mobility of Cubans, the development of trade relations and international tourism, as well as the existence of new forms of property recognized in the current cuban Constitution, mean that there are also more legal relations with foreign elements. The above confirms the need to implement a new system of rules of Private International Law in Cuba. In matters of international successions, the cuban conflict system present methods and techniques of regulation that today are insufficient; at the same time, it requires to be updated and must attend to the need that exists to give answers to the diversity of situations that arise in this type of private international relations. In that sense, in this article, the authors make a proposal of theoretical bases that could serve as support for an adequate conception of the cuban conflictive system in the matter of international successions, in order to favor the respect to the autonomy of the testator’s will and the right to succession due to the death of his heirs |
