| English abstract | This literature review article examines the crucial role of the Constitutional Court of Ecuador in the protection of human rights in the field of criminal law. The structure, functions and evolution of the Court since its establishment with the 2008 Constitution are addressed. The Court has undergone various structural changes, expanding the number of judges and creating specialized chambers to handle the increasing complexity of constitutional cases. The Court maintains broad powers, including the resolution of unconstitutionality actions and jurisdictional guarantees, which allows constant monitoring of compliance with constitutional principles and the protection of fundamental rights. In criminal jurisprudence, the Court has issued key decisions that strengthen due process guarantees, protect the rights of defendants, and ensure fair treatment in the criminal justice system. These decisions include the protection of the right to a fair trial, the presumption of innocence, and the inadmissibility of evidence obtained through coercion or torture. The Court has also stressed the importance of active participation and comprehensive reparation for crime victims. |
| Spanish abstract | Este artículo de revisión bibliográfica examina el papel crucial de la Corte Constitucional del Ecuador en la protección de los derechos humanos en el ámbito del derecho penal. Se aborda la estructura, funciones y evolución de la Corte desde su establecimiento con la Constitución de 2008. La Corte ha experimentado diversos cambios estructurales, ampliando el número de jueces y creando salas especializadas para manejar la creciente complejidad de los casos constitucionales. La Corte mantiene competencias amplias, incluyendo la resolución de acciones de inconstitucionalidad y garantías jurisdiccionales, lo que permite una vigilancia constante del cumplimiento de los principios constitucionales y la protección de los derechos fundamentales. En materia de jurisprudencia penal, la Corte ha emitido decisiones clave que fortalecen las garantías del debido proceso, protegen los derechos de los acusados y aseguran un trato justo en el sistema de justicia penal. Estas decisiones incluyen la protección del derecho a un juicio justo, la presunción de inocencia y la inadmisibilidad de pruebas obtenidas mediante coerción o tortura. La Corte también ha subrayado la importancia de la participación activa y la reparación integral de las víctimas de delitos. |
