| Spanish abstract | En los últimos tiempos la discusión académica sobre los derechos fundamentales ha sido abundante y enriquecedora, lo cual ha beneficiado en gran medida al fortalecimiento del constitucionalismo moderno. Sin embargo, al lado del desarrollo teórico de tales derechos han surgido diversos cuestionamientos éticos y filosóficos que en muchas ocasiones han tratado de ser respondidos sobre la base de premisas sumamente debatibles y efímeras. Tanto la prevalencia epistémica de ciertos derechos como la configuración estructural de diversos bienes jurídicos siguen siendo interrogantes sin resolver de manera satisfactoria en el ámbito jurisdiccional. | English abstract | In recent times academic discussion about fundamental rights has been abundant and enriching, which has benefited in large measure to the strengthening of modern constitutionalism. However, beside the theoretical development of such rights, it have emerged various ethical and philosophical questions that on many occasions have been answered on the basis of weak and ephemeral premises. Both epistemic prevalence of certain rights and the structural configuration of diverse juridical goods are still being questions with unsatisfactory answers in jurisdictional field.
