| Spanish abstract | El presente artículo deriva de una investigación financiada por el Consejo de Desarrollo Científico Humanístico y Tecnológico de la Universidad de Los Andes en el que fueron revisadas las Interpretaciones Prejudiciales del Tribunal de Justicia de la Comunidad Andina (TJCA) en Propiedad Intelectual, emitidas entre los años 1987 y 2004, con el objetivo de elaborar instrumentos que organicen la jurisprudencia y permitan a los funcionarios nacionales un acceso directo a las interpretaciones de las normas andinas. El análisis pretende aportar nuevos elementos a la discusión relacionados con las fortalezas y debilidades derivadas de la jurisprudencia del TJCA, con la finalidad de proponer algunas interrogantes sobre la excesiva reiteración en las Interpretaciones Prejudiciales del Tribunal Andino, en algunos temas problema relacionados con los Signos Distintivos |
| English abstract | The present article derives from an investigation funded by the Council for Scientific, Humanistic and Technological Development of the Universidad de los Andes where Prejudgment Interpretations, issued between 1987 and 2004 from Andean’s Community Court of Justice regarding Intellectual Property, were reviewed in order to create tools for organizing jurisprudence and to allow national agents direct access to Andean norm interpretation. The analysis attempts to add new elements to the discussion on strengths and weaknesses as derived from ACC jurisprudence, with the intention of proposing some questions on the excessive reiteration in Prejudgment Interpretations of the Andean Tribunal in some problem areas related to Distinctive Signs |
