| Spanish abstract | El presente artículo pretende abordar el tema de la criminalidad en torno a los indios de la Cordillera de Mérida a finales del siglo XVIII y principios del siglo XIX a través de dos juicios cuyos expedientes reposan en el Archivo General del Estado Mérida. El primer caso, trata de un sumario de 1800, seguido para averiguar las causas por las cuales un indio de la población de Ejido fue violentamente golpeado por un "vecino". Aquí se evaluará la importancia de la condición social y económica del indio como variable del crimen y la agresión. El segundo caso (1796) está referido a una causa por las resunciones sobre un labrador de Timotes que habría dado muerte a un indio. En este caso se determinarán los motivos circunstanciales del hecho y la condición social como condicionante y objeto de la agresión, así mismo las implicaciones del sistema punitivo con respecto a los procedimientos de la defensa |
| English abstract | The article deals with the criminality subject around the Indians of the Mountain range of Mérida’s city at the end of eighteen century, and the beginning of nineteen century. The first case, will deal with an 1800 summary, followed to find out the causes by which an Indian of Ejido’s town, was violently hit by a "neighbor". Here, it will be evaluated the importance of the social and economic condition of the Indian as variable of the crime and the aggression. The last case, (1796) is referred to one legal cause by the presumptions over a farmer of Timotes village that would have killed an Indian. In this case we will determine the circumstantial reasons for this crime and the social condition as object of the aggression. Also, we will study the implications of the punitive system and the defense procedures |
