| Spanish abstract | El inciso segundo del artículo 45 del anteproyecto de Código penal dispone la atenuación obligatoria de la pena para los partícipes en quienes no concurran las calidades que constituyen el fundamento de ilicitud del hecho punible. En el trabajo se estudia el alcance de esta disposición y su eventual compatibilidad con la categoría de los delitos de infracción de deber, que se superpone a la tradicional distinción entre delitos especiales propios o impropios. Este análisis de la compatibilidad teórica de la categoría, en la Parte General del anteproyecto, se complementa con el de su admisibilidad en relación con la concreta tipificación de algunos delitos en su Parte Especial (torturas, malversación, infidelidad en la custodia de documentos, detención ilegal y parricidio). Todo ello va antecedido de un estudio sobre el concepto de delito de infracción de deber, sus efectos, las críticas ha que ha sido sometido y su refutación |
| English abstract | The second interjection at the 45 article of the draft for the new Penal Code arranges the obligatory attenuation of the penalty for the participatants on whom do not concur the qualities that constitutes the illegal foundation of the punishing act. This text studies the reach of this disposition and its possible compatibility with the offenses related to breach of duty category. This type of offenses superposes with the traditional distintion of proper and improper special offences. This analisis of the teorethical compatibility of the category, at the draft’s general part, complements with the analisis of its admissibility in relation with the legal description of some offenses at the special part (tortures, embezzlement, infidelity at documents custody, illegal halting and parents murder). A previous study on the concept of the offenses related to breach of duty, its effects, the critics it has gone trought and its rebuttal |
