| Spanish abstract | A partir de la distinción entre soberanía original (como poder político supremo) y soberanía instrumental (en tanto poder derivado), se explora en este texto la legitimidad del derecho invocado por la sociedad política –como titular de la potestad suprema– de trastocar el orden político constituido que, sobre la base de la legalidad, se pretendía objetivado, despersonalizado y racional. En ocasión de los sucesos del 19 de abril de 1810, se discurre aquí en torno a la tensión entre el reconocimiento sacro del poder constituido y la concepción sobre la necesidad de alterar el orden político establecido, bien como deconstrucción del pacto articulador de la sociedad política o bien como redefinición del pacto, a efectos de realizar la retroversión de la soberanía instrumental depositada por tradición en manos del rey, y justificar la voluntad autónoma del soberano supremo (la “nación” venezolana) de configurar un gobierno propio, independiente del Estado español |
| English abstract | Drawing from a distinction between original sovereignty (as the supreme political power) and instrumental sovereignty (derived power), this article explores the legitimacy of the law as invoked by the political society as holder of the supreme authority to alter the constituted power. On legal grounds, it was intended to be objectified, depersonalized and rational. Regarding April 19, 1910, I tackle the tension between the recognition of the sacred constituted power and conception behind the need to alter the established political order, either as deconstruction of the articulating pact of the political society or as redefinition of the pact. This is in order to analyze the retroversion of instrumental sovereignty, traditionally in the hands of the king, and justify the autonomous will of the supreme sovereign (the Venezuelan “nation”) to form a government of its own, independent from the Spanish State |
