| Spanish abstract | Pensar la base del derecho, y especialmente de los derechos del hombre, no ya a partir de la libertad, sino de una responsabilidad infinita otorgada por el mandato irrecusable de la alteridad; concebir la justicia como asimetría y unos derechos que se reconocen fenomenológicamente de modo original como derechos del otro, antes que propios. Esta es la propuesta de Emmanuel Levinas para un acercamiento al problema de la fundamentación de los Derechos Humanos. En el presente trabajo se ensayará un proyecto de refundamentación de estos derechos a partir de una mirada general a la filosofía de Emmanuel Levinas y, especialmente, a la luz de sus escasos escritos sobre el tema. Se abordará para ello las líneas fundamentales de su filosofía del bien o ética, extrayendo de ahí los supuestos necesarios para soportar una cierta crítica del derecho. Para ello será necesario exponer los puntos nucleares de su meditación respecto de la alteridad, pues sólo a partir de un acercamiento a lo Otro es posible sostener algo así como la inviolabilidad absoluta del hombre, la imposibilidad radical de su alineación y reificación, además de la responsabilidad absoluta que ello trae consigo y que hace posible la justicia |
| English abstract | To think the base of right, and specially of the rights of men, not from freedom, but from a infinite responsibility given by the unavoidable mandate of alterity; conceiving justice as asymmetry and rights that recognize as phenomenological rights of the other, before than own. This is the proposal of Emmanuel Levinas to approach the problem of fundamenting Human Rights. In this work it will be essayed a project of refundamenting this rights from a general review of the philosophy of Emmanuel Levinas and, especially, in the light of his few works about the subject. The author approaches the fundamental lines of his philosophy of good or ethics, extracting from it the necessary aspects to support a kind of critique of right. For this, it will be necessary to expose the main points of his meditation about alterity, because only an approach to the other will sustain something like the absolute inviolability of man, the radical impossibility of his alignment and reification, besides of the absolute responsibility that it brings along and that makes justice possible |
