| Spanish abstract | O presente trabalho assenta função social da propriedade rural e da dignidade da pessoa humana. Foram abordados aspectos históricos afetos ao surgimento do sentimento de propriedade, bem como ao processo de conformação do direito de propriedade funcionalizado. A partir da análise do princípio da função social da propriedade rural sob o prisma constitucional, compreende intrínseco ao direito de propriedade, de forma que não poderá ser juridicamente consider proprietário aquele que não der ao bem destinação compatível com os ditames constitucionais. O estudo teve seu foco na análise do descumprimento da função social da propriedade rural, por meio da exploração de mão de obra em condições análogas a de esc descumprimento ao princípio da dignidade da pessoa humana. Ante a abordagem realizada defende-se a expropriação, para fins de reforma agrária, das terras particulares onde exista exploração de mão de obra em condições análogas a de escravo |
| English abstract | The present work is based mainly on analysis of the application of the principles of the social function of rural property and of the dignity of the human person. They were dealt with historical aspects affections to the emergence of the feeling of ownership, as well as the process of conformation of the right to property functionalized. From the analysis of the principle of the social function of rural property under the prism constitutional, one understands this principle as intrinsic to the right of ownership, in a way that may not be legally considered to be the owner who does not give the good disposition co constitutional dictates The study had its focus on the analysis of the failure of the social function of rural property, through the exploitation of the labor force in conditions similar to that of slave labor, therefore, in flagrant disobedience to the principle of the dignity of the human person. Compared to the approach held defends the expropriation, for purposes of agrarian reform, the private land where there is exploitation of labor in conditions similar to that of slaves |
