| English abstract | In order to support the need for the systematization of the norms related to land use planning and environmental protection in Cuba towards a better application of the postulates of urban resilience, this article is one of the results of the project associated with the National Program for Local Development in Cuba coordinated by the author: "The right to the city and its dimensions for local development in Las Tunas". Goal 11 of the 2030 Agenda for Sustainable Development, aimed at achieving more inclusive, safe, resilient and sustainable cities and human settlements, is taken as a reference. Based on this, it addresses the implications of urban resilience, given the challenges that cities face today to protect their inhabitants, their assets and the maintenance of functionality in the face of crises that may arise, especially due to the occurrence of natural and human phenomena and disasters, aspects that illustrate how in Cuba this is a relevant issue that occupies the current analysis of the way in which territories should be organized in the present and in the future, without leaving aside environmental protection, are discussed. It is emphasized how from the point of view offered by the Law, this is an issue that still does not find sufficient legal support and how the actions carried out with respect to urban resilience, respond fundamentally to other social sciences. |
| Spanish abstract | Con el objetivo de fundamentar la necesidad de la sistematización de las normas relativas al ordenamiento territorial y la protección al medio ambiente en Cuba hacia una mejor aplicación de los postulados de la resiliencia urbana, se realiza el presente artículo, devenido uno de los resultados del Proyecto Asociado al Programa Nacional de Desarrollo local en Cuba coordinado por la autora: "El derecho a la ciudad y sus dimensiones para el desarrollo local en Las Tunas". Se toma como referencia el Objetivo 11 de la Agenda 2030 para el Desarrollo Sostenible, encaminado al logro de ciudades y asentamientos humanos más inclusivos, seguros, resilientes y sostenibles. A partir de ello, se aborda lo que implica la resiliencia urbana, dado los retos que asumen hoy las ciudades ante los desafíos de proteger a sus habitantes, sus bienes y el mantenimiento de la funcionalidad ante las crisis que puedan presentarse, sobre todo, por la ocurrencia de fenómenos y desastres naturales y humanos. Son tratados aspectos que ilustran cómo en Cuba este es un asunto relevante que ocupa los actuales análisis relativos a la manera en que deben ser ordenados los territorios en el presente y en el futuro, sin dejar a un lado la protección medioambiental. Se enfatiza en cómo desde la óptica que ofrece el Derecho, este es un tema que no encuentra aún el respaldo jurídico suficiente y cómo las acciones realizadas respecto a la resiliencia urbana, responden fundamentalmente a otras ciencias sociales. |
