| Spanish abstract | Este artículo argumenta la existencia en Cuba de la familia transnacional y sostiene que el nuevo Código de las Familias debe restituir plenamente los derechos sucesorios de los ciudadanos cubanos emigrados que aún se rigen por disposiciones legales anteriores a la década de los años noventa del pasado siglo, las que no se corresponden con la evolución, motivaciones y peculiaridades actuales de la migración internacional desde Cuba, las reformas introducidas por el Gobierno en su política migratoria, la percepción prevaleciente en la sociedad sobre el acto de emigrar y los postulados constitucionales vigentes desde el año 2019. La pertinencia de que el artículo 470 del Código Civil sea derogado por el nuevo Código de las Familias, cuyo proyecto será sometido a referendo popular, se sustenta en la sustancial reforma al Código Civil que el mismo propone, en particular sobre los motivos que incapacitan para heredar, y la necesidad de suprimir las limitaciones que tienen los ciudadanos cubanos emigrados para heredar a sus familiares que permanecen en Cuba, debido exclusivamente a su condición migratoria |
| English abstract | This article argues the existence in Cuba of the transnational family and present that the new Family Code must fully restore the inheritance rights of emigrated Cuban citizens, who are still governed by legal provisions prior to the decade of the 1990s century which don´t correspond to the current evolution, motivations and peculiarities of international migration from Cuba, the reforms introduced by the Government in its migration policy, the prevailing perception in society about the act of emigrating and the constitutional postulates in force since 2019. The pertinence of repealed the article 470 of the Civil Code by the new Family Code, project that will be submitted to a popular referendum, is based on the substantial reform that it make about the Civil Code, particularly in relation to the successories incapacities and the need to eliminate the limitations that emigrated Cuban citizens have to inherit their relatives who remain in Cuba, due exclusively to their migratory status |
