Spanish abstract | La suspensión del procedimiento debida a la presunta enajenación mental del imputado, no ha resultado de fácil aplicación por los tribunales. Se realiza aquí un examen de las sentencias de la Corte Suprema que se han pronunciado sobre la materia, entre los años 2009 y 2016, y de aquellas dictadas por cortes de apelaciones que les han antecedido en cada proceso. Mediante este ejercicio es posible advertir cómo ha ido variando el sentido que se atribuye al artículo 458 del Código Procesal Penal, e identificar también importantes aspectos problemáticos, especialmente en cuanto a la aplicación de la internación provisional, así como de las medidas cautelares en general |
English abstract | The suspension of the proceeding due to the alleged mental insanity of the accused has not proved easy to apply by the courts. A review of the sentences ruled by the Supreme Court on the matter, between 2009 and 2016, is presented here, and those ruled by courts of appeals that have preceded them in each process. Through this exercise it is possible to see how the meaning attributed to article 458 of the Code of Criminal Procedure has been changing, and it is also possible to identify major problem areas, especially regarding the implementation of the provisional admission, as well as provisional admission in general |
