| Spanish abstract | El artículo se centra en el análisis de las formas de término de sentencias dictadas en procedimientos por delitos de amenazas y lesiones leves en contexto de violencia intrafamiliar, durante el año 2015 en el Juzgado de Garantía de Graneros, y algunas dictadas por el Tribunal Oral en lo Penal de Rancagua que conoció causas derivadas desde el Juzgado de Garantía ya mencionado. El propósito es mostrar empíricamente que la justicia penal no entrega una forma de solución de conflicto adecuada a los delitos de menor entidad en contexto de violencia intrafamiliar, específicamente los delitos de amenazas y lesiones clínicamente leves. El trabajo pretende aportar cifras y análisis que permitan abrir un debate sobre la respuesta que entrega la justicia penal a este tipo de delitos y critica el argumento que se esgrime en el sentido que todos los delitos de violencia intrafamiliar son un problema de género. | English abstract | This article will focus on the analysis of the forms of termination of sentences handed down in procedures for crimes of threats and minor injuries in the context of intrafamily violence, during the year 2015 in the Court of Guarantee of Granaries, and some dictated by the Oral Court In the Criminal of Rancagua that knew causes derived from the Court of Guarantee already mentioned. The purpose is to demonstrate empirically that the penal system does not prove to be a suitable solution for minor crimes in the context of intrafamily violence, specifically the crimes of threats and clinically mild injuries. The present work intends to provide figures and analyzes that allow to open a serious debate on the response that gives the criminal process to this type of crimes and criticizes the argument that is made in the sense that all crimes of domestic violence are a gender problem. The results and analysis of this study aim to encourage its replication to other regions, and thus reach general conclusions about the problem. I firmly believe that if we do not take charge of the figures that will show this work, which I hope will be complemented with national figures at some point, we will hardly be able to face the phenomenon of domestic violence and offer adequate mechanisms of solution for this type of conflict |
