Spanish abstract | En el presente trabajo se realiza un ejercicio de argumentación jurídica mediante la teoría de la ponderación propuesta por Robert Alexy, con el fin de identificar si ésta es una herramienta útil para las y los operadores jurídicos cuando deben deliberar sobre la colisión de derechos. Con la intención de concluir que esta línea argumentativa abona a un escrutinio más estricto y objetivo de cada caso y, por lo tanto, salvaguarda los derechos humanos de las personas involucradas. En ese sentido, a manera de ejemplo, se analizará la sentencia emitida por la Corte Interamericana de Derechos Humanos (Corte IDH) en el caso Gonzales1 Lluy y otros vs. Ecuador, bajo las premisas propuestas por Alexy |
English abstract | In this paper, an exercise of legal argumentation is carried out, under the theory of weighting proposed by Robert Alexy, to identify whether it is a useful tool for legal operators when they must deliberate on the collision of rights. With the intention of concluding that this line of argument contributes to a stricter and more objective scrutiny of each case and, therefore, safeguards the human rights of the people involved.
