| English abstract | Abortion is one of the most controversial issues in the contemporary legal debate of which Ecuador is not exempt. The positions that have been taken have involved moral, philosophical, bioethical, anthropological and specifically legal principles. The crucial point of the discussion can be focused on whether abortion can be considered a woman's right or whether, on the contrary, it constitutes a crime, as it affects a fundamental right enshrined and guaranteed by the National Constitution, such as the right to life. The purpose of this article is to systematize the arguments regarding the criminalization of abortion. For this purpose, a documentary review of the laws related to the subject, positions of international organizations, as well as bioethics and social science texts that review the discussion in several countries, was carried out in order to systematize the arguments of different documents and bibliographic material, which were analyzed and interpreted through different methods. In conclusion, it is considered that the discussion has highlighted apparent contradictions between norms at different levels, as well as ideological and philosophical differences |
| Spanish abstract | El aborto es uno de los puntos más polémicos en el debate jurídico contemporáneo del que no está exento Ecuador. Las posiciones que se han tomado han involucrado principios morales, filosóficos, bioéticos, antropológicos y específicamente legales. El punto crucial de la discusión puede focalizarse en si el aborto puede considerarse un derecho de la Mujer o si, al contrario, constituye un delito, al afectar un derecho fundamental consagrado y garantizado por la Constitución Nacional, como es el derecho a la vida. El presente artículo, tiene como objetivo sistematizar los argumentos respecto a la penalización del aborto. Para ello se procedió a una revisión documental de las leyes relativas al tema, posturas de organizaciones internacionales, así como textos de bioética y ciencias sociales que reseñan la discusión en varios países, para sistematizar las argumentaciones de diferentes documentos y material bibliográfico, que fueron analizados e interpretados mediante diferentes métodos. Como conclusión, se estima que la discusión ha puesto de relieve contradicciones aparentes entre normas de diferente nivel, así como diferencias ideológicas y filosóficas. |
