| English abstract | The legal principle of the "best interests of the child" is a fundamental concept in family law and in the protection of children's rights. The objective of this study was to analyze the legal principle of the best interests of the child in the case of the death of the parents in the Ecuadorian context. Regarding the methodological process, it was considered within the framework of a documentary study, based on the existing literature and theories, laws and legal studies in addition to the current regulations related to the legal principle of the best interest of the child. It became an analytical-synthetic study. As a result, the hierarchy of legal norms was determined. The analysis of the selected information allowed concluding that the legal principle of the best interest of the minor in Ecuador is oriented to guarantee the family, emotional and economic well-being of the minor in this orphanage through the processes of guardianship or adoption. |
| Spanish abstract | El principio jurídico del "interés superior del menor" es un concepto fundamental en el derecho de familia y en la protección de los derechos de los niños. El estudio tuvo objetivo analizar el principio jurídico del interés superior del menor ante la muerte de sus progenitores bajo el contexto ecuatoriano. En lo que respecta al proceso metodológico, se consideró dentro del marco de un estudio documental, sustentado en la literaturas y teorías existente, leyes y estudios jurídicos además de las regulaciones vigentes relacionadas con el principio jurídico del Interés Superior del Menor. Convirtiéndose en un estudio analítico-sintético. Como resultado se determinó la jerarquía de las normas jurídicas. El análisis de la información seleccionada permitió concluir que el principio jurídico del Interés Superior del Menor en Ecuador está orientado a garantizar el bienestar familiar, emocional y económico del menor en esta orfandad a través de los procesos de tutela o adopción. |
