| Spanish abstract | En el presente estudio se han revisado los conceptos de derecho de acceso a la información pública y función notarial, así como los expedientes de los procesos de habeas data seguidos contra el servicio notarial ante el Tribunal Constitucional Peruano. Ello nos ha permitido concluir que notario está obligado a entregar la información de carácter público que obra en su archivo notarial, sin perjuicio de las excepciones contempladas en la Ley. De igual forma nos permite visualizar un procedimiento legal mínimo este conlleva a una serie de actuaciones por parte del notario, luego del cual, en caso que el ciudadano no tenga por satisfecho su derecho podrá reclamarlo vía administrativa o judicial. El acceso a la información pública es un derecho humano que se encuentra íntimamente relacionado a la libertad de expresión, siendo que la información permite generar opinión pública constituye una plataforma para fortalecer la democracia. También es importante considerar que la digitalización del archivo notarial y de los actos notariales contribuyen a la transparencia, y a la lucha contra aquellos delitos derivados de las transacciones económicas ilegales |
| English abstract | In this study, the concepts of the right of access to public information and notarial function have been reviewed, as well as the files of habeas data proceedings against the notarial service before the Peruvian Constitutional Court. This has allowed us to conclude that a notary is obliged to deliver the information of a public nature that is in his notarial file, without prejudice to the exceptions contemplated in the Law. Likewise, it allows us to visualize a minimum legal procedure, this leads to a series of actions by the notary, after which, in the event that the citizen is not satisfied with his right, he may claim it administratively or judicially. Access to public information is a human right that is closely related to freedom of expression, since information allows the generation of public opinion and constitutes a platform to strengthen democracy. It is also important to consider that the digitization of the notarial file and notarial acts contribute to transparency, and to the fight against crimes derived from illegal economic transactions |
