| English abstract | The purpose of this paper is to analyze how the Court of Appeals of Rio Grande do Sul has been applying the preliminary injunction for the exclusion of virtual content on blogs and to compare this situation with the new preliminary injunction provided for in the Marco Civil da Internet, investigating possible new impacts on the decisions. The method of approach used was deductive, the method of procedure was comparative, and the research techniques were bibliographical and documental. As a result of the research, through the comparison between the way the preliminary injunctions for exclusion of blog content werebeing granted in the Court of Rio Grande do Sul and the new preliminary injunction provided for in the Marco Civil da Internet, it was identified that the decisions will need to go beyond the requirements that had been considered to also consider the importance of that content for the community |
| Portuguese abstract | O presente trabalho tem por objetivo analisar de que modo vinha sendo aplicada pelo Tribunal de Justiça do Rio Grande do Sul a antecipação de tutela para fins de exclusão de conteúdos virtuais em blogs e comparar tal situação com a nova medida liminar prevista no Marco Civil da Internet, investigando-se possíveis novos impactos aos julgados. O método de abordagem utilizado foi o dedutivo; o método de procedimento, o comparativo e as técnicas de pesquisa, a bibliográfica e a documental. Como resultado da pesquisa, mediante a comparação entre a forma como vinham sendo deferidas as antecipações de tutela para exclusão de conteúdos de blogs no Tribunal de Justiça do Rio Grande do Sul e a nova medida liminar prevista no Marco Civil da Internet, identificou-se que as decisões precisarão ir além dos requisitos que vinham considerando para sopesar também a importancia daquele conteúdo para a coletividade |
