| Spanish abstract | La función social de la propiedad es un concepto que necesariamente se encuentra ligado con el concepto del derecho de propiedad en general y sin distinción alguna, por lo cual dicho concepto resulta extensivo a las múltiples modalidades o tipologías del derecho de propiedad. Aquel reconoce ciertas garantías e impone a su vez múltiples limitaciones en su ejercicio al titular del derecho, cambiando de esa forma la tradicional concepción individualista de los derechos subjetivos, adicionando el componente del interés general como variable al momento de su ejercicio. Teniendo en cuenta lo anterior, el presente artículo se propone exponer los fundamentos constitucionales que permiten concluir con alto grado de certeza que el concepto de función social de la propiedad resulta extensivo a la institución de la propiedad intelectual |
| English abstract | The social function of property is a concept that is necessarily linked to the concept of the right to property in general and without any distinction whatsoever, which is why such concept is extensive to the multiple modalities or typologies of the right to property. The former recognizes certain guarantees and imposes in turn multiple limitations in its exercise to the holder of the right, thus changing the traditional individualistic conception of subjective rights, adding the component of the general interest as a variable at the time of its exercise. In view of the foregoing, this article sets out to explain the constitutional foundations that allow us to conclude with a high degree of certainty that the concept of the social function of property is extensive to the institution of intellectual property |
