| Spanish abstract | El objetivo de este trabajo es analizar el impacto del empaquetado genérico de los productos del tabaco, con respecto a las facultades que otorga el registro marcario a su titular y la afectación a las funciones distintivas de la marca. Del análisis surgen posiciones contrapuestas, a saber: por un lado, la importancia de proteger los derechos colectivos asociados a la salud pública que busca tutelar la medida, y por otro, la necesidad de proteger a los titulares de las marcas, los cuales se ven en la imposibilidad de utilizar sus signos distintivos bajo la normativa que se ha comenzado a aplicar en varios países del mundo |
| English abstract | The objective of this work is to analyze the impact of generic packaging on tobacco products, with respect to the powers granted by the trademark registration to its owner and the effect on the distinctive functions of the trademark. In this sense, conflicting positions emerge, these are, on the one hand, the importance of protecting the collective rights associated with public health that seeks to protect the measure and, on the other, the need to protect trademark owners, for whom it is impossible to use their distinctive signs under the regulations that have begun to be applied in several countries of the world |
