| Spanish abstract | El 19 de septiembre de 2016 Sony CSL, compañía desarrolladora de software, anunció la creación de la primera obra musical cuya titularidad adjudica a inteligencia artificial. El artículo analiza las consecuencias jurídicas de tal afirmación, así como los límites conceptuales y legales dentro del universo de derechos de autor, lo anterior con la finalidad de dilucidar si estamos en presencia de una nueva figura jurídico-autoral que invite a reflexionar sobre los sujetos de protección de nuestras leyes, o bien si aún estamos a una distancia razonable en que la normatividad aplicable resuelva la titularidad de derechos a favor de la inteligencia artificial en vez de hacerlo a favor de las personas jurídicas |
| English abstract | This year on September 19th, Sony csl, a software developer company, announced to the world, the creation of the first musical work whose ownership belongs to Artificial Intelligence. This paper analyzes the legal consequences of such a statement, and it’s conceptual and legal limits within the Copyright Universe (with fundament on International Treaties); in order to assess whether we are in presence of new legal-authorial figure that invite us to think over the subjects of protection in our laws or whether the applicable normativity may resolve these hypotheses in favor Artificial Intelligence, instead of juridical persons |
