| Resumen en español | La Oficina de Patentes Europea (EPO) protege las segundas indicaciones o usos sobre composiciones o sustancias ya existentes en el estado de la técnica con el ánimo de incentivar a la industria farmacéutica en Europa. Este artículo explora los aspectos legales y técnicos mediante los cuales la EPO ha otorgado patentes no solo a segundas indicaciones, sino también a terceras o sucesivas indicaciones. En particular, se analiza el alcance del Swiss-type Claim y el European-type Claim. De igual manera, se realiza un análisis comparativo entre el Convenio sobre Patentes Europeo y decisiones de la EPO, y la Decisión 486 de 2000 de la Comunidad Andina (Régimen Común sobre Propiedad Industrial) sobre segundas indicaciones |
| Resumen en inglés | The European Patent Office (EPO) grants patent protection on second indications or uses of substances or compositions comprised in the state of the art as it aim to encourage the pharmaceutical industry in Europe. This article explores the legal and technical aspects by which the EPO has granted patents not only second indications, but also subsequent indications. Particularly, the article analyses the scope of the Swiss-type Claim and the European-type Claim. Similarly, a comparative analysis between the European Patent Convention and EPO decisions, and Decision 486 of 2000 of the Andean Community (Common Intellectual Property Regime) on second indications is carried out |
