| Spanish abstract | El presente escrito es el resultado de los módulos uno y dos de la maestría en Derecho constitucional y Administrativo de la Universidad de la Habana, Cuba, como fundamento teórico de la investigación relacionada con la Historia de la Constitución y el estado de Derecho. Se trata de apreciar la capacidad histórica de los hombres para dar respuesta a la ordenación de las relaciones en la vida en colectivo, como presupuesto necesario e indispensable para el buen desenvolvimiento de esa vida. El estado de Derecho surge con la revolución Francesa de 1789 y es el resultado de la reacción contra el antiguo régimen absolutista; también se ofrecen criterios que inscriben la concepción histórica del estado de derecho durante el liberalismo alemán del siglo XIX |
| English abstract | This article is the result of what was learnt in the two modules of the Master in Constitutional and Administrative Law at the University of Havana, Cuba. It is a document about the theoretical fundamentals in the research about the history of the constitution and the social rule of law. This paper regards in the appreciation of the men’s historical ability to put order in people’s relations, which is pretty important for the development of society. The social rule of law arose during the French Revolution in 1789 and it is the consequence of the reaction against the absolute regime. Other criterion are offered to explain the historical conception about the social rule of law during the German Liberalism of the XIX century |
