| Spanish abstract | El presente artículo de revisión, aborda el estudio de la costumbre inveterada de los seres humanos de tener relaciones de pareja con varios miembros de su comunidad, sean de tipo heterosexual, bisexual u homosexual, y que hasta hace algún tiempo se mantenían en total clandestinidad, han obligado a los legisladores y jueces de la República de los diferentes países a emitir pronunciamiento legal y jurisprudencial que permitan resolver de manera equitativa la pensión de sobrevivientes, entendiendo por este comportamiento, que el trabajador cotizante o pensionado que convive con diferentes parejas tiene como fin último extender su brazo protector a todos por igual. En Colombia se venían haciendo pronunciamientos muy tímidos a través de la legislación y la jurisprudencia, pero a partir de la reforma constitucional de 1991, que incluye la igualdad material, se han hecho avances sustanciales, aceptando nuestra realidad social |
| English abstract | The present article of review, it approaches the study of the inveterate custom of the human beings of having relations of pair with several members of his community, be of heterosexual, bisexual or homosexual type, and that up to some time ago were kept in total stealthiness, have forced the legislators and judges of the republic of the different countries to issuing legal and juriprudential pronouncement that they allow to solve in an equitable way the survivors’ pension, understanding for this behavior, that the worker cotizante or pensioned that it coexists with different pairs it has as last end extend his protective arm to all equally. In Colombia they were coming doing very shy pronouncements across the legislation and the jurisprudence, but from the constitutional reform of 1991, which includes the material equality, substantial advances have been done, accepting our social reality |
