| English abstract | In the nineteenth century three laws regulating work contracts in Brazil were approved in 1830, 1837 and 1879 successively. In this article I will deal specifically with the first two laws, aiming to demonstrate that: 1) both laws were related to the uncertainties resulting from measures of the Atlantic traffic prohibition; 2) in order to regulate contracts made with immigrants, such laws had the object of making the performance of the colonization companies viable and restricting the autonomy of the hired workers, and 3) although they were seen as signs of juridical and social modernity of the post-Independency period, those laws were inspired by ancient juridical principles, updated within the new context of the period of time |
| Portuguese abstract | No século XIX, vigoraram no Brasil três leis reguladoras de contratos de trabalho, aprovadas, sucessivamente, em 1830, 1837 e em 1879. Neste artigo, tratarei especificamente das duas primeiras, buscando demonstrar que: 1) estiveram relacionadas, ambas, às incertezas decorrentes das medidas de proibição do tráfico atlântico; 2) regulando contratos feitos com imigrantes, objetivaram viabilizar a atuação das companhias de colonização e restringir a autonomia dos trabalhadores contratados; e 3) embora fossem vistas como sinais da modernidade jurídica e social do pós-Independência, inspiraram-se em antigos princípios jurídicos, atualizados no novo contexto em que se vivia |
