| Spanish abstract | El cambio en las características de la delincuencia, del derecho penal clásico al derecho penal de la globalización, ha llevado también a un cambio en la respuesta institucional para confrontarla; en ese orden de ideas, más que en la restricción de la libertad individual, el énfasis se ha puesto en la persecución de los beneficios patrimoniales obtenidos a través de la actividad delictiva. Ello ha llevado a recuperar y redimensionar la figura del comiso, para cuya eficacia ha sido menester acudir a su instrumentación cautelar. De esta última se ocupa el presente artículo, al examinar el régimen colombiano sobre la materia, contrastarlo con el del derecho español, y evaluar su eficacia como herramienta de política criminal del Estado |
| English abstract | The change in the characteristics of delinquency from a perspective of classis criminal law to globalized criminal law has required a change in institutional responses to it.; in that sense, more than in just the restriction of the individual freedom, the emphasis has been placed on in the pursuit of the patrimonial benefits obtained through the criminal activity. It has moved into the area of recovery and reconceptualization of property subject to forfeit. This requires an examination of the use and effectiveness of preventative or precautionary measures. In regard to the last point, it is the object of this article, when examining the Colombian law on the matter, to contrast it with that of the Spanish law, and to evaluate their effectiveness as a tool of state criminal policy |
