| Resumen en español | Es conocida la tensión latente que genera la existencia de instituciones que apuntalan su poder en fuentes de legitimidad distintas: de un lado encontramos a los órganos políticos (Gobierno y Congreso) como entes que derivan su legitimidad de las mayorías democráticas; y de otro, la jurisdicción, la cual no es elegida de manera directa por el pueblo y que a su vez sirve para contener las pasiones eventuales de este último (el pueblo). Ante la resurrección de tesis conservadoras, se hace necesario un estudio histórico y jurídico del fundamento de la jurisdicción constitucional y el Tribunal Constitucional –como parte integrante de la jurisdicción–, pues ante los constantes cuestionamientos que se les hace, es inevitable interrogarse acerca de si es posible predicar la existencia de la democracia sin la presencia de esta figura dentro del panorama orgánico de un Estado de Derecho |
| Resumen en inglés | Is known the tension that generates the existence of institutions that underpin their power in different sources of legitimacy: in one side are the politic organs (Govern and Congress) as entities that derive their legitimacy from democratic majorities; and in the other side, is the jurisdiction, which is not elected directly by the people and that at the same time controls the possible passions of this one (the people). In front of the resurrection of conservative thesis, it is necessary a historic and legal study about the foundation of the constitutional jurisdiction and the Constitutional Court –as an integral part of the jurisdiction–, because of the constants questions that are made, we try to analyze if it is possible preach the existence of democracy without the presence of this institute into the organic panorama of the State of Law |
