| Spanish abstract | Partiendo de los conceptos de mutación constitucionaly constitucionalismo viviente, se procura detectar sus semejanzas y diferencias, repasando las distintas variantes doctrinales que existen respecto a cada uno de ellos, lo que complica notoriamente su estudio. Luego de la reseña conceptual se plantean ciertas bases para el análisis de estos temas, y se traslada el estudio a los artículos 72 y 216 de la Constitución uruguaya. El autor concluye que respecto al artículo 72 se ha producido una evolución interpretativa propia de la noción de la constitución viviente, pero sin llegar a una mutación en sentido estricto. Distinto es el caso del artículo 216 respecto al cual sí se presenta un caso de mutación, aunque con algunos problemas |
| English abstract | Based on the concepts of constitutional mutation and living constitutionalism it is intended to identify their similarities and differences, reviewing the various doctrinal variants that exist with respect to each of them, which significantly complicates their study. After the conceptual review raised some bases for the analysis of these issues and the study moves to Articles 72 and 216 of the Uruguayan Constitution. The author concludes that regarding Article 72, there has been an interpretative evolution of the notion of the living constitution, but without a mutation in strict sense.
