| Spanish abstract | La realidad nos muestra que el Derecho es afectado cada vez más por una dinámica que le es propia. En efecto, el Derecho es evolutivo por esencia. Lo que sí puede ser nuevo es la velocidad a la que se produce esta evolución e interrelaciones crecientes que existen entre las distintas ramas del Derecho. También puede presentar algún grado de novedad la interacción cada vez mayor entre el Derecho Internacional y el Derecho Constitucional. Esta interacción del Derecho Internacional y el Derecho Constitucional se produce en amplios ámbitos de este ordenamiento, pero, particularmente, en la esfera relativa a los Derechos Humanos. De acuerdo con nuestro punto de vista, la penetración del Derecho Internacional de los Derechos Humanos en la esfera constitucional se ve reflejada, entre otros ámbitos, en las fuentes del Derecho Constitucional, de tal manera que altera el orden jerárquico de las fuentes e, incluso, la articulación misma de las fuentes |
| English abstract | The reality shows us that law is increasingly affected by a particular dynamic. Indeed, law is evolving by nature. That it can actually be definitely new it is the speed on which that evolution and the increasingly interrelations existing among the different legal areas. The ascending interaction and rapport between the international law and the constitutional law might also be new in a certain degree. However, this interaction to the international law and the constitutional law actually happens in wide realms of the constitutional legal system, and particularly happens in the human rights field. From our standpoint, the penetration of international human rights law in the constitutional law field has a consequence in the constitutional law sources, in the sense that it modifies the hierarchical order of the sources and yet its articulation itself |
